Environment Agency CAR response deadlines explained
After an Environment Agency compliance assessment, the Compliance Assessment Report (CAR) will usually record what must be done and by when. This note explains the typical dates and deadlines you may see on the form. Source: EA assessing and scoring guidance (OGL v3.0).
When you receive the CAR
The EA usually aims to send the CAR within 14 days of the assessment date (or within 14 days of receiving monitoring data for a desktop assessment). The form will be posted and/or emailed to the permit holder and then placed on the public register.
Action dates on the form
If non-compliances have been found, the CAR will usually record:
- What is wrong — the breach or issue.
- What action is required — steps to achieve compliance.
- Deadline — response by date or compliance deadline.
- Enforcement stance — whether the EA is considering escalated enforcement.
Action dates vary depending on the severity and nature of the breach. They are set by the assessing officer based on what is needed to return to compliance or to prevent environmental impact.
Raising concerns about findings
If a permit holder disagrees with the findings, published EA guidance describes raising concerns with the issuing officer within 14 calendar days of receipt of the CAR. This is an informal internal review, not a statutory appeal. The officer should respond with an explanation or a revised assessment.
Regulatory appeals
If the concerns remain unresolved, the permit holder may request a regulatory appeal within 28 calendar days of the officer's response. This guide does not advise whether or when to appeal; that decision should be taken with appropriate support.
Compliance and follow-up assessments
The EA may schedule a follow-up assessment or request evidence that actions have been completed by the stated deadline. If the deadline passes without compliance, further enforcement action may follow.
